The Utah Chapter of Community Associations Institute serves the educational, business, and networking needs of Community Associations in the state of Utah. The Utah General Legislative Session of 2013 produced three bills that became law. These laws apply to both condominiums as well as single-family associations. Perhaps the most important one is Senate Bill 64. Under current Utah state law, community associations are required to fund a reserve account. SB 64, which will take effect on July 1st, 2014, will give control of reserve studies to associations’ Boards of Directors. The law does have a few requirements; it specifies what a reserve analysis must include, such as what items will eventually need funding from reserves, the life expectancy of those items, and their replacement or repair cost.
SB 64 also mandates that each association provide all of its owners with a summary of the reserve analysis each year. Furthermore, associations must provide a complete copy of the assessment upon request of an owner. The law requires that a line item be sat aside for reserve funds in the annual budget, but it leaves the amount of the reserve in the discretion of the board, based on the reserve analysis. Finally, SB 64 allows residents of community associations to veto the amount set aside for reserves, if they choose.

Recent Legislation in Utah That Concerns HOAs
In 2013, the Utah Genreal Legislative Session passed three bills regarding community associations. All across the nation, states are revising and enacting new laws which help govern condos, townhome communities, and HOAs. These bills were enacted and are officially law in Utah:
Amendments to State Bill 90
This law has several parts-
- It makes the Community Association Act applicable to any community association that has one or more residential lots.
- It bans an association for charging a fee for the review and approval of plans to construct/improve a unit/lot that is more than the cost of the review and approval.
- It addresses how to handle certain types of insurance claims.
- It allows single-family associations to access lots or units as needed to maintain or repair common areas.
- It defines the procedure for two or more community associations that wish to merge into one.
- It allows unit/lot owners to remove or change a wall shared by two units as long as both units are owned by the same person, granted that a few provisions are met.
State Bill 64
- It mandates that community associations include a reserve fund in their annual budget, though it leaves the amount of the reserve in the discretion of the association.
- It allows the members of the association (homeowners) to veto the amount of reserve funding with a majority vote of the owners, which must be called within 45 days
- It gives procedures for individual homeowners if any association is not in compliance with the law.
House Bill 101
HB 101, which requires all community associations to register with the state, was amended for clarification only.
As we can see, these amendments are all coming in an effort to make things easier for those in leadership positions within Utah’s community associations.
